Terms and Conditions of Sale

Okamarkt – Switzerland

These Terms and Conditions govern the sale of products through the Okamarkt platform. By purchasing from us, you agree to the following terms.

1. Scope and Applicability

These Terms apply to all purchases made through Okamarkt, whether online or in-store. They cover second-hand goods and new end-of-series items verified by our internal team.

2. Product Condition

We sell:

  • Second-hand items (used, inspected, and clearly described).
  • End-of-series items (new, offered at reduced prices due to clearance).

Product listings include accurate descriptions and images. Customers are expected to review item conditions before purchase. Normal signs of wear on second-hand goods are not considered defects.

3. Pricing and Payment

All prices are listed in Swiss francs (CHF) and include applicable VAT where required.

Payment must be made in full at the time of order via the payment methods offered on our platform.

4. Return and Refund Policy

All sales of second-hand and end-of-series items are final.

We do not accept returns, refunds, or exchanges, unless:

  • The product is significantly not as described, or
  • It has a hidden defect not disclosed at the time of sale.

In such cases, Swiss warranty law (Articles 197–210 of the Swiss Code of Obligations) may apply. Claims must be submitted within 7 calendar days of receipt, with supporting documentation.

5. Delivery and Collection

Delivery times are estimates and not guaranteed.

We are not responsible for delays caused by third-party logistics providers.

Customers must inspect items upon delivery or collection and report any issues promptly.

6. Liability

Okamarkt is not liable for:

  • Minor defects or signs of wear on second-hand items.
  • Indirect or consequential damages.
  • Improper use or modification of purchased goods.

Our total liability is limited to the purchase price of the item.

7. Ownership and Risk

Ownership transfers upon full payment. Risk transfers upon delivery or collection.

8. Governing Law and Jurisdiction

These terms are governed by Swiss law.

Jurisdiction is in the competent courts of the Canton where Okamarkt is registered, unless otherwise required by mandatory consumer protection law.
